1. PROGRAM DESCRIPTION AND CONSENT

These SMS Terms and Conditions apply to SMS messages sent by Elite Football Agency Pty Ltd ABN 99 656 286 154, trading as Elite Football Agency, referred to in these terms as “EFA”, “we”, “us” and “our”.

Where you have provided your consent, we may use your mobile number and other contact details to send you SMS communications about our services, events, programs, player registrations, waitlist updates, offers, promotions and opportunities. By opting in, you consent to receive SMS messages from EFA at the mobile number you provide.

Consent to receive SMS marketing communications is not a condition of purchasing any goods or services from EFA.

2. MESSAGE FREQUENCY

Message frequency may vary depending on your interaction with EFA, including your registrations, enquiries, waitlist status, event participation and communication preferences.

3. COSTS

Message and data rates may apply, according to your mobile carrier's plan.

4. HOW TO OPT OUT

You may opt out of receiving SMS marketing communications at any time by replying STOP to any SMS message from us.

After you reply STOP, you may receive one confirmation message confirming that you have been unsubscribed. We will then stop sending SMS marketing communications to that mobile number, unless you later opt in again.

If you opt out of SMS marketing communications, we may still contact you for non-marketing purposes, including to provide information about your account, registration, booking, purchase, trial, event, safety matters, service updates, administrative matters, or changes to our terms, policies or operations.

6. ELIGIBILITY AND MINORS

Our SMS marketing program is intended for adults.

Where a player is under 18 years of age, SMS marketing communications must be directed to the player’s parent or legal guardian, rather than to the player directly.

By providing a mobile number for SMS marketing communications in connection with a player under 18, you confirm that:

  • you are the player’s parent or legal guardian;
  • you consent to receiving SMS marketing communications from EFA; and
  • the mobile number provided belongs to you and not to the player.

We do not knowingly send SMS marketing communications directly to a player under 18. If we become aware that a mobile number belonging to a player under 18 has been submitted for SMS marketing, we may suppress that number from SMS marketing communications.

7. CARRIER LIABILITY

Carriers are not liable for delayed or undelivered messages.

8. PRIVACY

We handle personal information in accordance with our Privacy Policy, available at:

We do not sell or rent mobile information, SMS opt-in data or SMS consent records.

We do not share mobile information, SMS opt-in data or SMS consent records with third parties or affiliates for their own marketing or promotional purposes.

We may disclose mobile information and SMS opt-in data to service providers who help us operate our SMS messaging program, such as our SMS platform provider, solely for the purpose of delivering and managing SMS communications on our behalf. Those service providers are not authorised to use that information for their own marketing purposes.

9. Changes to These SMS Terms

We may update these SMS Terms and Conditions from time to time. The current version will be made available on our website with the updated “Last updated” date.
