1. WHO WE ARE
Elite Football Agency (ELITE FOOTBALL AGENCY PTY LTD, ABN 99 656 286 154, "EFA", "we", "us", "our") is a football talent placement organisation based in Australia. This Privacy Policy explains how we collect, use, disclose, and protect personal information, including in connection with our SMS messaging program.


2. INFORMATION WE COLLECT
We may collect the following types of personal information:

  • Identity and contact details, including name, mobile phone number, email address, date of birth, age, location, city, region and country of
    origin.
  • Player information, including playing position, age group, current club or academy, playing history, football CVs, footage, highlight reels
    and other information relevant to representation, trials, placement opportunities or events.
  • Parent or guardian details, where the player is under 18, including the name, mobile phone number, email address and relationship of the
    parent or legal guardian.
  • Travel and identity information, where relevant to trials, placement opportunities or events, including passport details, visa-related
    information, flight itineraries and other travel information.
  • Payment and billing information, which may be processed through Shopify or another payment provider.
  • Marketing and communication preferences, including whether you have opted in or opted out of receiving marketing communications
    from us.
  • Messaging and engagement data, including SMS opt-in records, SMS delivery status, unsubscribe records, email engagement data and
    interactions with links that we send.
  • Website, analytics and advertising data, including cookies, analytics information, advertising identifiers, pages visited, device
    information, browser information and information collected through advertising and retargeting tools such as Meta and TikTok pixels.
  • Other information that you provide to us when you contact us, register for an event, complete a form, make an enquiry, purchase a
    service, or otherwise interact with us.

We will only collect personal information where it is reasonably necessary for our functions and activities, or where otherwise permitted by law.

3. HOW WE USE INFORMATION
We may collect, use and disclose personal information for the following purposes:

  • to provide and manage our football talent placement, representation, trial, event and related services;
  • to register and manage players for events, trials, programs and placement opportunities;
  • to assess player suitability for opportunities with professional clubs, academies, trial partners and other football organisations;
  • to communicate with players, parents, guardians, clubs, academies and service providers;
  • to manage waitlists, bookings, subscriptions, payments, billing and customer support;
  • to send service-related communications, including information about registrations, events, trials, bookings, purchases, operational updates and administrative matters;
  • to send marketing communications where consent has been provided, or where we are otherwise permitted to do so under applicable law;
  • to manage marketing preferences, including opt-in and opt-out requests;
  • to maintain records of consent, communications and transactions;
  • to improve our services, website, communications and advertising;
  • to conduct analytics, advertising and retargeting activities;
  • to comply with legal, regulatory, accounting, tax and administrative obligations; and 
  • for any other purpose notified to you at the time of collection or otherwise permitted by law.

4. PIVACY ACT AND AUSTRALIAN PRIVACY PRINCIPLES
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. We collect personal information by lawful and fair means and, where practicable, directly from the individual concerned. Where the individual is under 18, we may collect personal information from, or with the involvement of, a parent or legal guardian.


5. MARKETING COMMUNICATIONS, MOBILE INFORMATION AND SMS CONSENT
We may use your personal information, including your name, email address, mobile number and details of your interactions with us, to send you marketing communications about our services, events, programs, offers, promotions and opportunities.

We will only send SMS marketing communications where consent has been provided, or where we are otherwise permitted to do so under applicable
law.

By opting in to receive SMS marketing communications from us, you agree that we may send promotional SMS messages to the mobile number provided. Message frequency may vary. Message and data rates may apply.

You may opt out of receiving marketing communications from us at any time by:

  • replying STOP to any SMS message from us;
  • using the unsubscribe function in any marketing email from us; or
  • contacting us using the contact details set out in this Privacy Policy.


If you opt out of receiving marketing communications, we may still contact you for non-marketing purposes, including to provide information about your account, registration, booking, purchase, trial, event, safety matters, service updates, administrative matters, or changes to our terms, policies or operations.

We do not sell or rent mobile information or SMS opt-in data. We do not share SMS opt-in data or SMS consent records with third parties for their own marketing or promotional purposes.


We may disclose mobile information and SMS opt-in data to service providers who help us operate our SMS messaging program, such as our SMS platform provider, solely for the purpose of delivering and managing SMS communications on our behalf.

Those service providers are not authorised to use that information for their own marketing purposes. Where the player is under 18, SMS marketing communications must be directed to the player’s parent or legal guardian, unless we notify you otherwise and obtain any required consent.


6. WHEN WE DISCLOSE PERSONAL INFORMATION
We do not sell or rent personal information.
We may disclose personal information to:

  • professional clubs, academies, scouts, trial partners and football organisations, where relevant to representation, trial, placement or
    development opportunities, and with the player’s or parent/guardian’s knowledge or consent where required;
  • service providers who help us operate our business, including providers of CRM systems, SMS messaging, email marketing, ecommerce, payment processing, website hosting, subscriptions, event ticketing, automation, scheduling, cloud storage, document management, analytics and customer support;
  • payment and ecommerce providers, including Shopify and related applications, to process purchases, subscriptions, event registrations and billing;
  • advertising and analytics partners, including Meta, TikTok and similar providers, for advertising, retargeting, audience creation, campaign measurement and analytics;
  • professional advisers, including lawyers, accountants, consultants and insurers;
  • government, regulatory or law enforcement bodies, where required or authorised by law; and
  • other parties where you have consented to the disclosure or where the disclosure is otherwise permitted by law.

Where we use advertising partners, we may use website cookies, pixels and advertising identifiers to show retargeting ads and measure advertising performance. We may also upload customer contact details, such as name and email address, to create custom audiences, where permitted by law and by the relevant platform terms.


We do not provide SMS opt-in data or SMS consent records to advertising partners for their own marketing purposes.


7. DATA RETENTION
We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including to provide our services, manage our relationship with you, comply with legal and regulatory obligations, resolve disputes, maintain business records and enforce our rights.

We may retain records of SMS consent, marketing preferences and unsubscribe requests for as long as reasonably necessary to demonstrate compliance with our legal obligations and to ensure that we comply with your communication preferences.
When personal information is no longer required, we will take reasonable steps to destroy it or de-identify it, unless we are required or permitted by law
to retain it.

8. DATA SECURITY
We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure.

These steps may include access controls, password protections, use of reputable service providers, secure data storage, staff access limitations, internal procedures and periodic review of our privacy and data handling practices.
However, no method of transmission or storage is completely secure. We cannot guarantee the security of information transmitted to us over the internet, by email, by SMS, or through third-party platforms.


9. MINORS
EFA works with football players who may be under 18 years of age.
Our SMS marketing program is intended for adults. Where a player is under 18, SMS marketing communications must be directed to the player’s parent or legal guardian, rather than to the player directly.
To support this approach:

  • we may ask for a player’s date of birth or confirmation of age;
  • where the player is under 18, we may collect the parent or legal guardian’s contact details and consent;
  • we may flag records to identify whether a player is under 18;
  • we do not knowingly send SMS marketing communications directly to a player under 18;
  • if a mobile number belonging to a player under 18 is submitted for SMS marketing in error, we may suppress that number from SMS marketing communications; and
  • a parent or legal guardian may contact us to request access to, correction of, or deletion of their child’s personal information, subject to any
    legal or operational requirements that apply.


This does not prevent us from sending necessary service-related communications to a parent or guardian about a player’s registration, trial, event, booking, placement opportunity, safety issue, account matter or other non-marketing matter.


If EFA expands into the United States or begins collecting personal information from children under 13 in the United States, we will implement additional consent, notice and parental control processes required by applicable US children’s privacy laws.


10. INTERNATIONAL DATA TRANSFERS
EFA is based in Australia and currently provides its services primarily in Australia.
Some of our service providers and technology platforms may store, process or access personal information outside Australia, including in the United States and other countries. These providers may include CRM systems, SMS providers, email marketing platforms, ecommerce platforms, payment processors, analytics providers, advertising platforms, cloud storage providers and automation tools.


Where we disclose personal information overseas, we will take reasonable steps to ensure that the disclosure is consistent with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
If EFA expands its services into other jurisdictions, including the United States, we may update this Privacy Policy and our related terms to address any additional privacy, marketing, child protection or consumer law requirements that apply.


11. YOUR RIGHTS
You may request access to, or correction of, personal information that we hold about you by contacting us using the details below.

You may also contact us if you:

  • wish to update your contact details;
  • wish to update your marketing preferences;
  • wish to opt out of marketing communications;
  • have questions about how we handle personal information; or
  • wish to make a privacy complaint.

We will respond to privacy requests and complaints within a reasonable period.
If you are not satisfied with our response to a privacy complaint, you may contact the Office of the Australian Information Commissioner.

12. CHANGES TO THIS POLICY
